1. Acceptance of Terms

By accessing or using the Creator Gist platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Creator Gist provides a content intelligence platform that indexes publicly available content from connected social media profiles, analyzes performance patterns, and generates content recommendations. The Service is provided on a subscription basis.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information during registration.

4. Subscription and Payment

The Service is offered as a monthly subscription at the price listed on our pricing page. Subscriptions renew automatically unless cancelled before the next billing cycle. Refunds are not provided for partial billing periods.

We reserve the right to change subscription pricing with 30 days’ prior notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

5. Usage Limits

Your subscription includes defined usage limits for smart refreshes, chat requests, and connected profiles as described on the pricing page. Usage beyond these limits may be restricted. We do not charge overage fees; excess requests are simply declined until the next reset period.

6. Data and Content

You retain all rights to your content. By connecting a social media profile, you grant Creator Gist a limited, non-exclusive license to access and index publicly available content and metrics from that profile for the purpose of providing the Service.

We do not claim ownership of your content or the recommendations generated from your data. Recommendations are provided as suggestions and should be evaluated using your own editorial judgment.

7. Acceptable Use

You agree not to:

• Use the Service to violate any applicable law or regulation
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated means to access the Service beyond the provided interface and API
• Resell, sublicense, or redistribute the Service or its output without our prior written consent
• Interfere with or disrupt the integrity or performance of the Service

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee the accuracy, completeness, or reliability of any recommendations or data provided through the Service.

Content recommendations are algorithmically generated and should not be construed as professional advice. You are solely responsible for editorial decisions based on the Service’s output.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Creator Gist shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, data, or profits, arising from your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the twelve months preceding the claim.

10. Termination

You may cancel your subscription at any time through your account settings. We may terminate or suspend your access to the Service immediately, without prior notice, for conduct that we determine violates these Terms or is harmful to other users or the Service.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
